By accessing or using Maanchitra ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service.

These terms apply to all users, including visitors, registered users, and subscribers.

2. Definitions

• "Service" refers to the Maanchitra website, mobile application, and all related features
• "Company," "we," "us," "our" refers to MotherShepherd Private Limited
• "User," "you," "your" refers to the person accessing or using the Service
• "Content" refers to all historical maps, timelines, events, media, and information provided through the Service
• "Premium Features" refers to features accessible only to paid subscribers
• "Account" refers to your registered user profile

3. Eligibility

• You must be at least 18 years old to create an account and purchase subscriptions
• If you are under 18, you may use the Service only with parental/guardian consent and supervision
• You must provide accurate and complete information during registration
• You represent that you have the legal capacity to enter into a binding contract under Indian law

4. Account Registration and Security

4.1 Account Creation

• You must create an account to access certain features
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access

4.2 Account Restrictions

• One person may create only one account
• Sharing account credentials is prohibited
• Accounts are non-transferable
• We reserve the right to suspend or terminate accounts that violate these terms

5. Subscription Plans and Payments

5.1 Subscription Types

We offer the following subscription plans:

• Free Plan: Limited access to basic features
• Monthly Subscription: Full access, renews monthly
• Quarterly Subscription: Full access, renews every 3 months
• Annual Subscription: Full access, renews yearly

5.2 Payment Terms

• All payments are processed in Indian Rupees (INR)
• Payments are processed through Razorpay, our authorized payment gateway partner
• Subscription fees are charged in advance for each billing period
• All fees are inclusive of applicable GST and other taxes as per Indian law
• Payment methods accepted: UPI, Credit Card, Debit Card, Net Banking, Wallets

5.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled before the renewal date
• You will receive email reminders 7 days and 24 hours before renewal
• The renewal amount will be charged to your payment method on file
• You can cancel auto-renewal anytime through your account settings

5.4 Price Changes

• We reserve the right to change subscription prices at any time
• Price changes will not affect your current subscription period
• You will be notified 30 days before any price increase
• Continued use after a price increase constitutes acceptance of the new price

6. Refund and Cancellation

7. User Conduct and Prohibited Activities

7.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

7.2 Prohibited Activities

You must NOT:

• Violate any applicable laws, regulations, or third-party rights
• Share, sell, or distribute your account credentials
• Use automated systems (bots, scrapers) to access the Service
• Attempt to gain unauthorized access to our systems or other user accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Copy, reproduce, or distribute Content without our written permission
• Use the Service for commercial purposes without our authorization
• Upload viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Circumvent payment mechanisms or access premium features without payment

7.3 Consequences of Violation

Violation of these prohibited activities may result in:

• Immediate suspension or termination of your account
• Forfeiture of any subscription fees paid
• Legal action and liability for damages
• Reporting to law enforcement authorities

8. Intellectual Property Rights

8.1 Our Content

All Content on Maanchitra, including but not limited to:

• Historical maps, timelines, and event data
• Text, images, videos, and multimedia
• Software, code, and user interface
• Logos, trademarks, and branding

is owned by MotherShepherd Private Limited or our licensors and is protected by Indian and international copyright, trademark, and intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, non-commercial purposes
• View and interact with Content as intended by the Service

8.3 Restrictions

You may NOT:

• Download, copy, or redistribute Content (except as explicitly permitted)
• Use Content for commercial purposes without written permission
• Remove copyright notices or watermarks
• Create derivative works based on our Content

8.4 User-Generated Content

If you submit any content (comments, feedback, suggestions):

• You retain ownership of your content
• You grant us a worldwide, royalty-free license to use, display, and distribute it
• You represent that you have all rights to submit such content

To the maximum extent permitted by Indian law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee that the Service will be uninterrupted, error-free, or secure

• We do not guarantee compatibility with all devices or browsers
• Your use of the Service is at your own risk

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, consequential, or punitive damages
• Our total liability to you will not exceed the amount you paid for subscriptions in the past 12 months
• We are not liable for damages arising from unauthorized access to your account (if not due to our negligence)
• We are not liable for third-party actions (payment gateway, hosting providers, etc.)

Consumer Protection Act Notice: Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019.

12. Indemnification

You agree to indemnify, defend, and hold harmless MotherShepherd Private Limited, its directors, officers, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms and Conditions
• Your violation of any laws or third-party rights
• Your use or misuse of the Service
• Unauthorized access to your account due to your negligence

13. Data Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with Indian data protection laws.

14. Third-Party Services

The Service may contain links to third-party websites or integrate with third-party services:

• We are not responsible for third-party content, policies, or practices
• Use of third-party services is subject to their own terms and conditions
• We do not endorse or guarantee third-party services

15. Service Modifications and Termination

15.1 Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service at any time
• Change these Terms and Conditions (with notice to users)
• Update Content, fix errors, or improve functionality

15.2 Service Termination

We may terminate or suspend the Service:

• For business reasons (with 30 days notice and pro-rata refunds for active subscriptions)
• Due to legal or regulatory requirements
• For maintenance or technical reasons (temporary suspension)

15.3 Account Termination

We may terminate your account if:

• You violate these Terms and Conditions
• You engage in fraudulent activity
• You initiate chargebacks or payment disputes without valid reason
• Your account remains inactive for more than 2 years (with 30 days email notice)

15.4 User-Initiated Termination

You may terminate your account at any time through your account settings or by contacting support. Account deletion is permanent and cannot be undone.

16. Dispute Resolution

16.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@maanchitra.in to attempt to resolve the dispute informally.

16.2 Arbitration (Optional)

If informal resolution fails, disputes may be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996:

• Arbitration will be conducted in Bangalore, Karnataka, India
• The arbitration will be conducted in English
• The arbitrator's decision will be final and binding

16.3 Consumer Forum

As a consumer, you have the right to approach the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of India, including but not limited to:

• The Indian Contract Act, 1872
• The Information Technology Act, 2000
• The Consumer Protection Act, 2019
• The Copyright Act, 1957

All disputes are subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

18. Force Majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including:

• Natural disasters, epidemics, pandemics
• War, terrorism, civil unrest
• Government actions, strikes, lockouts
• Internet or telecommunications failures
• Cyber attacks, server failures

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and MotherShepherd Private Limited regarding the Service.

21. Updates to Terms

We may update these Terms and Conditions from time to time. Changes will be effective upon posting with an updated "Last Updated" date. Material changes will be notified via:

• Email notification to registered users
• Prominent notice on the Service
• In-app notification (if applicable)

Your continued use of the Service after changes constitutes acceptance of the updated Terms.
